A federal appeals court has thrown out a drug-maker's proposed lawsuit against the Food and Drug Administration and a number of health care companies.
In the first of three appeals to a federal court, the Federal District Court in Boston ruled that a drug manufacturer was entitled to substantial damages from the FDA because it took the drug from a seller of drugs to the consumer's doorstep. The court found that the manufacturer failed to provide adequate notice of its intention to market the drug at a price higher than that which would otherwise be required under the Food and Drug Act.
